What documents should I bring to the notary for the sale?

The notary must draw up the deed of sale and verify the identity of the parties, the title of the seller and the method of payment

In a home sale, buyer and seller must go to the notary to sign the public deed of sale. It is the last step to formalize the transfer of a property, so it is essential that both the current and the future owner of the house know what documentation they must bring on the day of signing so that everything goes smoothly.


And it is that the lack of some paper can cause the delay of the signing of the sale or, even, prevent it. Next, we detail which are the documents that the buyer of the house must deliver in the signature before a notary and which documents must be provided by the seller. What are they asking of us in each case?


What documents to take to the notary if you are a buyer?

The most important day has finally arrived in the process of buying and selling your future home, when the house definitely changes hands and the keys are handed over.

So that there is no problem or missing documentation, as a buyer you must provide several papers the day the deed is signed before a notary. This is the main documentation to be delivered:

DNI/CIF or valid residence card. Buyer, seller and guarantor, if any, must present their valid identity document to identify themselves before the notary

Marital status, matrimonial regime and domicile

Personalized information sheet (FIPER) and binding offer. These are two documents that the bank will have given you and that should be taken to the notary to rule out any doubts or erroneous information

Power of attorney. This document must be provided in the event that someone acts on your behalf if you cannot appear at the notary

Earnest money contract. If a payment has been made to the seller to secure the home purchase, it will also be necessary to provide it on the day of signing


It is important to go with all the necessary documentation to avoid nerves and upsets on the day of signing

You should not worry, since, if you have any doubts, you can ask the notary which are the documents to be delivered on the day of signing. You must also contribute the money to pay for the house. Keep in mind that the most common and advisable payment method is by bank check.

Remember that at the time of signing, you must have the mortgage approved, the check for the payment ready, the provision of mortgage funds.


What documents to take to the notary if you are a seller?

If you are the current owner and you are about to change hands, you will be the one who will have to deliver more documentation on the day of signing. To avoid last-minute nerves, we recommend that you carefully review what papers you need to formalize the transaction on the day the purchase and sale contract is signed before a notary. Take note!

DNI/CIF or valid residence card

Marital status, matrimonial regime and domicile

Property title. As the current owner, you must deliver the deed of the property, inheritance or donation before a notary. This is the most important document that you must bring on the day of signing

Receipt of the last payment of the IBI (Real Estate Tax). As a seller, you must provide the last IBI receipt to demonstrate that you are up to date with payment

Certificate of energy efficiency of the house. All homes for sale or rent must have this certificate, which measures the level of energy efficiency of the property

Community payment certificate. Also, you must prove that you are up to date with the expenses of the community of neighbors

Certificate of occupancy. You only have to present it if you sell a home in certain autonomous communities. Check if in your case you must have this document ready when selling the apartment

Document proving payment for supplies. You must also prove that you are up to date with bill payments such as electricity, water and gas

Certificate of outstanding mortgage debt. In the case of having a pending mortgage, you must ask the bank for this certificate if you are going to pay off the loan with the money from the sale

Inheritance acceptance document. If the house for sale is inherited, you must bring the deed of acceptance on the day of signing

Power of attorney. You will also need this document if you cannot go to the notary office on the day of the signing and someone does it for you
